Abstract

The Roman criminal law undergoes an early development by the hand of a lex horrendi carminis that is presented to combat the most serious crimes that a Roman can commit in the community. The prisoners, in a period in which Law and Religion are interdependent, will be designated as cursed men, and therefore their processing will be exceptional, as well as their execution. The primitive severity with which the punishments are applied is tempered during the Republic until it disappears.
