The electronic holographic will: a criticism of its admissibility

This article analyzes the possibility of adapting the formal requirements of the holographic will to the current technological context, assessing the shift from manual writing and handwritten signatures to digital media and electronic signatures. Taking Article 688 of the Civil Code in relation to Article 3.1 of the same legal body as its central object of study, it evaluates whether the social reality of the present time enables an evolutionary reading of its solemnities. Through a critical approach, this paper addresses the limits of the sociological canon of interpretation against the spirit and purpose of the rule, analyzing the risks, the asymmetry of guarantees, and the legal feasibility of the electronic holographic will hypothesis.
